Exchange 2010 Getting a Lot of SPAM mails and Some of the Internal Mails goes to Junk Folder

I have noticed 2 issues lately in My exchange 2010 SP2 :

Some of the internal mails are going to Junk mail folder ,i so not have any content or anti spam filtering enabled.

We have a third part resource who takes care of our spam filtering .

Second issue is we are getting a lot of spams , however the opriginating IPS of all the spam mails are legitimate what do i need to do to block these as spam ?
